Terms and Conditions of Tutoreasy
Hi and welcome to the tutoreasy user agreement (the "Agreement"), detailing the terms and conditions of your relationship with Tutoreasy Limited ("tutoreasy"). Usage of tutoreasy services indicates acceptance of the terms and conditions of this Agreement by you (the "user").
Please contact us if you have any specific questions or refer to our Frequently Asked Questions.
Prior to using the service or becoming a member you must read, agree with and accept all of the terms and conditions contained in this Agreement and the Privacy Policy, which include those terms and conditions expressly set out below, those incorporated by reference, and agreeing to receipt of regular newsletters from Tutoreasy, before you may become a user of tutoreasy services.
The terms and conditions of use will have to evolve to take account of new legislation, customs and practices, and evolution of the services being offered. These changes will be posted on the site, so users should review this section on an ongoing basis. Material changes will be notified to users by e-mail prior to being implemented.
Do you qualify to become a member?
Users have to be over the age of 18. If users are under 18 then their parent or guardian has to approve this Agreement on a users behalf. Without meeting these criteria users should not use this site. Business entities becoming members are allowed but the applicant must be acting in accordance with their authority within that business to make the application.
What are the costs of using the service?
We have a joining fee for tutors but students can join without a charge. Fees are charged for creating seminars or lectures and for undertaking tutorials, seminars or lectures. These will be clearly stated on the website Fees and reimbursements may change from time to time, with not less than 7 days notice being given of any changes. The currency of all fees will be clearly stated, and the taxes relating to the transaction are the responsibility of the member.
Tutoreasy acts as the marketplace for tutors and students - it is not the deliverer of the events.
Tutoreasy allows tutors to offer and deliver their services online. We are not responsible for the content, quality, or pricing of the tutoring services being delivered. There are few restrictions on what can be tutored and the quality of the tutoring will not be monitored by tutoreasy, though appropriate tools will be made available to allow for tutors to be assessed for quality, and for significant issues to be raised and resolved. We have no involvement in the transaction between the parties, except to facilitate the introduction of the parties, the provision of the online technology to carry out the tutorial, and the payment capability.
How do I know the identity of the tutor/student?
We believe that privacy and protection of users personal details are the key elements required to provide a safe environment for tutors and students. As such we recommend adopting practices such as, not sharing your real name, using user IDs, not divulging users' addresses etc. However, we cannot - due to the nature of the Internet - validate the identity of users. If a user has concern about the quality or substance of the tutorial or interaction being undertaken we will provide mechanisms for this to be flagged and investigated.
Controlling Content
We do not control the information provided by users that is made available through tutoreasy. While users are advised to use care and judgment in all transactions we will provide mechanisms for you to report activity or content that is illegal, offensive, harmful, inaccurate, or deceptive. There are also risks relating to dealing with underage persons (and local laws that must be adhered to) or people acting under false pretences. Transactions will typically be low value and of an individual nature so the opportunity for large scale deception is reduced.
Particular awareness needs to be paid to the content of learning activities and ensuring that the session relates only to the agreed subject and does not lead to either party divulging personal information or undertaking communication which is not relevant to the session.
Given the global nature of this service there are risks that the users must accept and are deemed to have done so by using the service.
Providing Tutoring Services
As a provider of services, the tutor is obligated to complete the transaction with the buyer at the price agreed via the service. Material used in the session must respect the laws of copyright that apply in the country of the tutor's location. Users who are identified as breaching copyright will be reported to the appropriate authorities.
Buying Tutoring Services
Payment for services is made in advance of the session taking place. Users are not able to retract payment once it has been made. Provision will be made for the return of monies (less administrative costs) should the tutor fail to attend the agreed session or where there is a technical failure that can be wholly attributed to tutoreasy.
User's Information
Data submitted to tutoreasy as part of the registration or update of registration details will not be available to other users, except for user ID and subject related information. This is intended to protect privacy of users. Users are responsible for the information that they provide and must ensure that it is accurate. Tutoreasy accepts no responsibility for the information that is provided.
What am I not allowed to do?
It is reasonably straight forward - nothing that breaks laws or is likely to cause offence to other users. Users must submit information that is true, accurate, and not misleading. Copyright, patent, trademark, and other intellectual property rights must not be infringed.
Activity on the site must not:
- violate any law, statute, ordinance or regulation
- be defamatory, trade libellous, unlawfully threatening or unlawfully harassing
- be obscene or contain child pornography
- contain any viruses, Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information
- create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers or organizations where the users utilize the services

9. Licence and Privacy
To use the service users will provide us with information that we utilise free on your behalf, with tutoreasy undertaking no violation of your copyright or other rights. We will treat this information with respect and only use it to enhance the service we offer to users, and to expand the reach of tutoreasy and its services. As such we will not sell or license this information to any third party. This information is stored in the United Kingdom and is subject to the laws and regulations of England.
Access and Interference.
Users agree that they will not: (i) take any action that imposes, or may impose in our sole discretion an unreasonable or disproportionately large load on our infrastructure; (ii) copy, reproduce, modify, create derivative works from, distribute or publicly display any content (except for user information) from the site without the prior expressed written permission of tutoreasy and the appropriate third party, as applicable; (iii) interfere or attempt to interfere with the proper working of the Site or any activities conducted on the site.
Using and Maintaining The Quality of Feedback.
We require the feedback capability to reflect the quality of the services being provided. We take the right to remove users who attract negative feedback. Any feedback left on tutoreasy does not reflect the views of tutoreasy or its employees or directors. We will provide the capability to review exceptional circumstances that have led to negative feedback, and can reinstate users where reasonable evidence is found to counter the negative feedback.
Breach
Initial response to the breach of any of these terms and conditions of use will be suspension and removal from the service. This will not limit tutoreasy in taking alternative or additional actions.
Guarantees and Warranties
We will take all reasonable action to ensure that the service delivered meets expectations and evolves with the advancement of technology. However, no employee, director, supplier or shareholders provides warranties or guarantees for the service being delivered nor for the content of the sessions. The aforementioned will not be liable for lost profits or additional costs connecting in anyway with use of this service. At most we limit any amount owed - without prejudicing local legislative rights - to being the amount earned by tutoreasy from the user in the 3 months prior to the action being raised.
Indemnity
User agrees to indemnify and hold us and (as applicable) our parent, subsidiaries, affiliates, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable legal costs, made by any third party due to or arising out of your breach of this Agreement or the documents it incorporates by reference, or violation of any law or the rights of a third party.
Legal Compliance
User shall comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of our service..
Relationship with tutoreasy
User is an independent contractor using tutoreasy, and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.
Resolving Disputes
We intend to resolve any disputes quickly and with real consideration of the issues being raised. We provide the means for parties to raise any issues directly with us, in order that they can be identified and investigated quickly, effectively, and efficiently. In using this service you accept that this is the first resort. If this does not provide satisfactory resolution then we will appoint an Arbitration body to investigate and adjudicate. For disputes where the damages will not exceed £5,000 the outcomes of this body shall be binding.
Disputes between tutors and students are not disputes between the party raising the issue and tutoreasy. We shall comply with legal requirements to provide evidence but are unable to investigate or adjudicate in such disputes.
General
This Agreement shall be governed in all respects by the laws of England. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
Service Provision
The services hereunder are offered by tutoreasy. No guarantee is provided as to the security, quality, consistency, or accessibility of our services.
